1.3 The General Terms and Conditions can be consulted at any time on the Website by clicking on the “General Terms and Conditions” tab at the bottom of the home page of the Website. The General Terms and Conditions in force at the time of your order on the Website shall apply.
ARTICLE 2 – ORDERING PRODUCTS
2.1 Creating a customer account
To be able to order products on the Website, you must create a customer account. To do this, you can fill in the form in the “Create account” section of the Website, complete the fields marked with an asterisk and click on “Create new account”.
In particular, you must enter the user name you have chosen (unless it is already being used by another customer) and the password you have chosen.
Once you have registered, you will receive a confirmation e-mail with a link to activate your account, which you must click on to finalise your registration.
You undertake to provide accurate and up-to-date details of your identity and address and to update these in the event of a change, in particular if your e-mail or postal address changes.
2.2 Product selection
You can consult the tabs dedicated to the product categories on the Website and find out about the characteristics of the products by clicking on the product sheet on the Website. To add a product to the shopping basket, you must select the quantity and, if applicable, the size of the product before clicking on the “Add to basket” button, subject to availability, which may be indicated by the words “Product available”.

2.3 Prices of the products

The prices shown on the product sheet on the website do not include delivery costs, which are shown when the delivery method is selected.
2.4 Overview of the products added to the shopping basket
Once you have selected products, you can view the items in your shopping basket by clicking on “Complete my order” at the top right of the website. You can add several products to your shopping basket overview or remove selected products and then click on “Update shopping basket” or continue shopping by clicking on “Complete my order”.
Consequently, MWT DIGIT reserves the right to refuse any order from a CUSTOMER with whom such a dispute exists.
To proceed with your order of products:
If you do not yet have a customer account, you can create one by clicking on “Create account”;
If you already have a customer account, you will be asked to identify yourself by entering your username and password and clicking on “Connect”.
2.5 Choice of shipping method and shipping fees
Once you have logged into your customer account, you will need to fill in the details of your billing address, delivery address, delivery method and your chosen payment method, then check your order summary and click “Continue to next step”.
Home delivery
For home delivery, the delivery costs are added to the price of the goods ordered and are to be borne exclusively by you. Delivery is carried out by La Poste in mainland France, Corsica and the French overseas departments and territories.
If you are not present at the address you have provided at the time of delivery, a delivery note will be left in your letterbox: The parcel can then be collected from the post office within 15 days of this slip being deposited. If the above deadline is exceeded, the parcel will be returned to MWT DIGIT.
Unless otherwise stated on the website and depending on the availability of the products, you will receive the products within 30 working days at the latest. If the Products are not delivered within the period indicated when you placed your order on the Website, you may request MWT DIGIT by registered letter with acknowledgement of receipt to deliver the Products within a reasonable additional period. If we still fail to deliver the goods within this new deadline, you may terminate the contract by registered letter with acknowledgement of receipt. The contract shall be deemed terminated on the date on which we receive this letter, unless we have not delivered the products in the meantime. The amounts you have paid will then be refunded to you within 30 days of the termination of the contract, without interest or compensation.
2.6 Confirmation of your order
To register your order of products, you must :

2.7 Payment of your order
You warrant that you have all the necessary authorisations to pay for your order with the bank card used.
You must enter your credit card details and click on “Submit”. Payment of your order confirms its validity.
When purchasing and paying on the website, the customer’s bank details are deleted after the transaction is completed and archived for a maximum of 13 months for evidentiary purposes in the event of a dispute relating to the payment. To ensure the security of payments made on the website, we use the services of a service provider whose payment pages use the TLS protocol and are PCI-DSS certified. ARTICLE 3 – RIGHT OF CANCELLATION
When you receive the product, you have the option of exercising your right of cancellation and returning the product that does not suit you. You are responsible for the costs of returning the product.
3.2 How to exercise your right of cancellation
If you simply wish to return a product ordered on the Website, you have a period of 14 (fourteen) clear days from the date of receipt of the products at your address to withdraw from the contract by sending us the withdrawal form below or a letter of withdrawal (giving the details specified in the withdrawal form below):

If the cancellation period expires on a Saturday, Sunday or public holiday, it will be extended until the next working day.
3.3 Returning the products
Once you have informed us of your wish to withdraw from the contract, you have 14 days to return the products to MWT DIGIT in one of the following ways:

The cost of returning or refunding the products in question shall be borne by the customer.
We reserve the right to refuse the exercise of the right of withdrawal to a customer who has returned or refunded one or more items whose value has been reduced by handling other than that necessary to establish the nature and characteristics of the products.
3.4 Refund in the event of cancellation
We will refund the full price paid for the returned or returned product(s), as well as the delivery costs (excluding the cost of returning or returning the item(s)), whichever is earlier, from the date of receipt of the returned products or the date on which the customer provides proof of dispatch or return of the products.

ARTICLE 5 – LEGAL GUARANTEES FOR PRODUCTS
(1) The seller is liable for defects in the product sold in accordance with Article L.217-4 et seq. of the French Consumer Code and for hidden defects in the item sold in accordance with Article 1641 et seq. of the French Civil Code.
Within the framework of the statutory warranty obligation, the consumer :
– has a period of two years from the date of delivery of the goods to bring an action;
– may choose between repair or replacement under the conditions set out in Article L.217-9 of the French Consumer Code;
– is exempt from the obligation to prove the existence of a lack of conformity for a period of twenty-four months from the delivery of the goods.
The consumer may invoke the guarantee against hidden defects in the goods sold, as defined in Article 1641 of the French Civil Code. In this case, the consumer has the choice between cancelling the contract or reducing the purchase price in accordance with Article 1644 of the French Civil Code.

ARTICLE 7 – COMPLAINTS AND DISPUTE RESOLUTION
7.1 The GTC are governed by French law.
7.2 In the event of a dispute, you may have recourse to a conventional dispute resolution procedure free of charge.
To make use of this conciliation procedure, you must first send your complaint to MWT DIGIT by registered letter with acknowledgement of receipt. If you do not receive a satisfactory response within one month, you can contact the conciliator, whose procedure is described on his website.
Arbitration is optional, confidential and free of charge, with the exception of any legal fees or expert opinions, which are at your expense.
A dispute cannot be mediated if :
– you cannot prove that you have previously attempted to settle your dispute directly with MWT DIGIT by means of a written complaint;
– the claim is manifestly unfounded or abusive,
– the dispute has already been or is being dealt with by another mediator or court,
– you have submitted a claim to the intermediary more than one year after you submitted a written complaint to MWT DIGIT;
– the dispute does not fall within the jurisdiction of the mediator.
If you are not satisfied with the outcome of the mediation or do not wish to use the mediation procedure, you may, at your option, apply to the competent court at the registered office of MWT DIGIT or to the competent court at your place of residence.
